  现将《关于进一步推进本市旧区改造工作的若干意见》印发给你们,请认真按照执行。

关于进一步推进本市旧区改造工作的若干意见

  住房问题是重要的民生问题。旧区改造是提高市民居住质量、改善城区居住环境的重要途径,是贯彻落实科学发展观、全面建设小康社会、构建社会主义和谐社会的重要举措。上海历届市委、市政府十分重视旧区改造工作。上世纪90年代“365”危棚简屋改造,本世纪初新一轮旧区改造,以及“十一五”中心城区二级旧里以下房屋改造,全市共拆除危旧房7000多万平方米,约120万户家庭改善了居住条件。同时,也要清醒地看到,上海旧区改造任务仍然非常艰巨。为进一步推进本市旧区改造工作,现提出如下若干意见:
  一、明确旧区改造总体要求和工作原则
  (一)明确总体要求。总体要求是:全面贯彻落实科学发展观,以加快推进“四个率先”、加快建设“四个中心”和筹办2010年上海世博会为契机,在总结历年旧区改造工作经验的基础上,坚持从实际出发,动员社会各方力量,实事求是,尽力而为,积极探索适合特大型城市发展规律的旧区改造新机制,全力推进本市旧区改造工作。
  (二)确定工作原则。具体为:坚持创新机制、完善政策。建立与尊重民意、住房保障、多渠道安置相结合的旧区改造方式,并注重政策的连续性、稳定性、操作性。
  坚持公开透明、公平公正。进一步突出旧区改造公益性的特征,努力形成居民主动参与、操作规范有序、社会广泛支持的良好局面。
  坚持点面结合、突出重点。在积极推进已启动旧改项目改造的同时,加大力度,重点推进中心城区成片、成规模和群众改造意愿强烈的二级旧里以下房屋改造。
  坚持政府主导、以区为主。市政府负责统筹、协调、推进和政策制定等工作,有关区政府作为旧区改造的责任主体,具体承担组织实施和推进工作。
  二、积极探索旧区改造新机制
  (三)扩大旧区改造事前征询制度试点。在试点地块启动改造前,按照市建设交通委、市住房保障房屋管理局制定的旧区改造事前征询制度的规定,开展两轮征询,充分听取市民群众对旧区改造意见。第一轮,征询改造区域居民意愿,同意改造户数超过规定比例,办理地块改造前期手续;第二轮,征询居民房屋拆迁补偿安置方案意见,在一定时间内,签订附生效条件的房屋拆迁补偿安置协议的居民户数超过规定比例,进入实施改造阶段。
  (四)完善居住房屋拆迁补偿安置办法。居住房屋拆迁补偿安置试行以被拆除房屋的市场评估价为基础,增加一定的价格补贴和套型面积补贴的办法。对补偿安置后居住仍然困难的被拆迁人,符合本市住房保障条件的,可申请保障性住宅解决居住困难。具体办法由市住房保障房屋管理局另行制定。
  (五)实行多种安置方式。在居住房屋拆迁实行货币补偿或跨区域异地安置的基础上,增加本区域就近安置方式。货币补偿、就近安置和跨区域异地安置的补偿安置标准基本等同。
  三、加大旧区改造政策扶持力度
  (六)加大市、区财力支持力度。对市、区合作,纳入年度土地储备计划的旧区改造项目,市发展改革、财政、土地部门在审核市土地储备专项资金年度收支计划时,按照不低于项目总投资的30%安排改造资金。有关各区在编制年度财政预算时,相应增加对旧区改造资金投入。
  (七)实行旧区改造土地储备资金先行拨付办法。对出让的土地储备旧改地块,在取得土地出让收入后,按照市发展改革委批准的土地储备投资总额90%的比例,先行拨付部分土地储备资金,在核定土地储备成本后再予以清算。
  (八)优先供应配套商品房和就近安置房建设用地。市、区有关部门要进一步落实配套商品房和就近安置房建设用地,确保土地供应。在符合城市规划情况下,企业提供自有土地建设就近安置房,且就近安置房建造面积比例不低于可建面积50%的,土地管理部门采取招标方式确定建设单位。
  (九)建立旧区改造审批绿色通道。按照“精简、高效、规范、透明”的原则,完善旧改项目审批方式,优化办理流程,提高审批效率。
  (十)引进社会资金参与旧区改造。积极探索选择有品牌、有实力、有经验的开发企业参与旧区改造的途径。
  (十一)鼓励和引导金融机构加大对旧区改造的信贷支持力度。金融机构根据信贷原则和监管要求,对土地储备机构和房地产企业参与旧区改造,提供融资支持和相关金融服务。探索通过信托、债券等金融工具,拓宽旧区改造融资渠道。
  四、多渠道筹措动迁安置房源
  (十二)积极推进就近安置房建设。有关各区根据市建设交通委制定的保障性住宅建设技术标准,在本区域范围内建设适配的紧凑型、小户型就近安置房。就近安置房建设、销售、管理等,参照本市配套商品房有关规定执行。
  (十三)加快配套商品房建设。市、区相关部门根据旧区改造计划和动迁房源需求情况,抓紧推进配套商品房建设,加大供应力度。同时,继续完善配套商品房基地市政、公建、公用、公交等配套设施建设。在配套商品房大基地内,积极引进优质的教育、卫生、商业等社会资源。
  (十四)收购中低价普通商品住宅。有关各区政府根据房地产市场发展情况和动迁居民实际需求,可收购适配的中低价普通商品住宅,供动迁居民选择安置。
  五、继续坚持“拆、改、留”多种改造方式
  (十五)进一步推进旧住房综合改造。对部分结构相对较好、但建筑和环境设施标准较低的旧住房,按照“业主自愿、政府主导、因地制宜、多元筹资”的原则,通过成套改造、综合整治、平改坡以及拆除重建等方式,多渠道、多途径地改善市民群众居住质量和环境。
  (十六)继续推进历史文化风貌区和优秀历史建筑整治。在严格执行上海市历史文化风貌保护区规划和《上海市历史文化风貌区和优秀历史建筑保护条例》有关规定的情况下,继续推进历史风貌保护区和优秀历史建筑保护整治试点,在有效保护历史建筑风貌的同时,努力改善居民的居住条件。
  六、进一步完善组织协调机制和工作制度
  (十七)建立旧区改造工作协调机制。成立上海市旧区改造工作领导小组,由市政府主要领导担任组长,分管副市长担任副组长,市建设交通委、市住房保障房屋管理局、市规划国土资源局、市发展改革委、市经济信息化委、市国资委、市财政局、市公安局、市监察局、市民政局、市金融办、市政府法制办、市政府新闻办、市信访办和中心城区10个区为成员单位。领导小组办公室设在市建设交通委。
  有关各区政府要成立相应机构,负责本区域范围内旧区改造组织实施工作。有关街道(镇)要全力配合,协同推进旧区改造,并做好社会稳定和居民思想工作。
  (十八)落实工作责任。有关区政府主要领导是本区旧区改造工作的第一责任人,实行目标责任制管理,纳入政绩考核范围,并接受人大、政协的监督以及社会各界、市民群众的监督。
  (十九)引入第三方参与房屋拆迁的监督。在坚持“阳光拆迁、公开操作”制度的基础上,有关各区可邀请人大代表、政协委员、社区工作者、法律界人士等,参与房屋拆迁全过程监督。
  (二十)营造良好社会氛围。各级政府要进一步强化旧区改造大局意识、群众意识、责任意识,注重发挥新闻媒体宣传引导作用,提高市民群众的参与意识,增强市民群众对旧区改造的理解和支持。
  本意见自印发之日起施行。此前发布的本市旧区改造有关规定和政策与本意见不一致的不再执行。

    關於進一步推進本市舊區改造工作的若干意見

      住房問題是重要的民生問題。舊區改造是提高市民居住質量、改善城區居住環境的重要途徑,是貫徹落實科學發展觀、全面建設小康社會、構建社會主義和諧社會的重要舉措。上海歷屆市委、市政府十分重視舊區改造工作。上世紀90年代“365”危棚簡屋改造,本世紀初新一輪舊區改造,以及“十一五”中心城區二級舊里以下房屋改造,全市共拆除危舊房7000多萬平方米,約120萬戶家庭改善了居住條件。同時,也要清醒地看到,上海舊區改造任務仍然非常艱鉅。為進一步推進本市舊區改造工作,現提出如下若干意見:
    一、明確舊區改造總體要求和工作原則
      (一)明確總體要求。總體要求是:全面貫徹落實科學發展觀,以加快推進“四個率先”、加快建設“四個中心”和籌辦2010年上海世博會為契機,在總結歷年舊區改造工作經驗的基礎上,堅持從實際出發,動員社會各方力量,​​實事求是,盡力而為,積極探索適合特大型城市發展規律​​的舊區改造新機制,全力推進本市舊區改造工作。
      (二)確定工作原則。具體為:堅持創新機制、完善政策。建立與尊重民意、住房保障、多渠道安置相結合的舊區改造方式,並註重政策的連續性、穩定性、操作性。
      堅持公開透明、公平公正。進一步突出舊區改造公益性的特徵,努力形成居民主動參與、操作規範有序、社會廣泛支持的良好局面。
      堅持點面結合、突出重點。在積極推進已啟動舊改項目改造的同時,加大力度,重點推進中心城區成片、成規模和群眾改造意願強烈的二級舊里以下房屋改造。
      堅持政府主導、以區為主。市政府負責統籌、協調、推進和政策制定等工作,有關區政府作為舊區改造的責任主體,具體承擔組織實施和推進工作。
      二、積極探索舊區改造新機制
    (三)擴大舊區改造事前徵詢制度試點。在試點地塊啟動改造前,按照市建設交通委、市住房保障房屋管理局製定的舊區改造事前徵詢制度的規定,開展兩輪徵詢,充分聽取市民群眾對舊區改造意見。第一輪,徵詢改造區域居民意願,同意改造戶數超過規定比例,辦理地塊改造前期手續;第二輪,徵詢居民房屋拆遷補償安置方案意見,在一定時間內,簽訂附生效條件的房屋拆遷補償安置協議的居民戶數超過規定比例,進入實施改造階段。
    (四)完善居住房屋拆遷補償安置辦法。居住房屋拆遷補償安置試行以被拆除房屋的市場評估價為基礎,增加一定的價格補貼和套型面積補貼的辦法。對補償安置後居住仍然困難的被拆遷人,符合本市住房保障條件的,可申請保障性住宅解決居住困難。具體辦法由市住房保障房屋管理局另行製定。
      (五)實行多種安置方式。在居住房屋拆遷實行貨幣補償或跨區域異地安置的基礎上,增加本區域就近安置方式。貨幣補償、就近安置和跨區域異地安置的補償安置標準基本等同。
      三、加大舊區改造政策扶持力度
    (六)加大市、區財力支持力度。對市、區合作,納入年度土地儲備計劃的舊區改造項目,市發展改革、財政、土地部門在審核市土地儲備專項資金年度收支計劃時,按照不低於項目總投資的30%安排改造資金。有關各區在編制年度財政預算時,相應增加對舊區改造資金投入。
    (七)實行舊區改造土地儲備資金先行撥付辦法。對出讓的土地儲備舊改地塊,在取得土地出讓收入後,按照市發展改革委批准的土地儲備投資總額90%的比例,先行撥付部分土地儲備資金,在核定土地儲備成本後再予以清算。
    (八)優先供應配套商品房和就近安置房建設用地。市、區有關部門要進一步落實配套商品房和就近安置房建設用地,確保土地供應。在符合城市規劃情況下,企業提供自有土地建設就近安置房,且就近安置房建造面積比例不低於可建面積50%的,土地管理部門採取招標方式確定建設單位。
    (九)建立舊區改造審批綠色通道。按照“精簡、高效、規範、透明”的原則,完善舊改項目審批方式,優化辦理流程,提高審批效率。
    (十)引進社會資金參與舊區改造。積極探索選擇有品牌、有實力、有經驗的開發企業參與舊區改造的途徑。
    (十一)鼓勵和引導金融機構加大對舊區改造的信貸支持力度。金融機構根據信貸原則和監管要求,對土地儲備機構和房地產企業參與舊區改造,提供融資支持和相關金融服務。探索通過信託、債券等金融工具,拓寬舊區改造融資渠道。
      四、多渠道籌措動遷安置房源
    (十二)積極推進就近安置房建設。有關各區根據市建設交通委製定的保障性住宅建設技術標準,在本區域範圍內建設適配的緊湊型、小戶型就近安置房。就近安置房建設、銷售、管理等,參照本市配套商品房有關規定執行。
      (十三)加快配套商品房建設。市、區相關部門根據舊區改造計劃和動遷房源需求情況,抓緊推進配套商品房建設,加大供應力度。同時,繼續完善配套商品房基地市政、公建、公用、公交等配套設施建設。在配套商品房大基地內,積極引進優質的教育、衛生、商業等社會資源。
    (十四)收購中低價普通商品住宅。有關各區政府根據房地產市場發展情況和動遷居民實際需求,可收購適配的中低價普通商品住宅,供動遷居民選擇安置。
    五、繼續堅持“拆、改、留”多種改造方式
    (十五)進一步推進舊住房綜合改造。對部分結構相對較好、但建築和環境設施標準較低的舊住房,按照“業主自願、政府主導、因地制宜、多元籌資”的原則,通過成套改造、綜合整治、平改坡以及拆除重建等方式,多渠道、多途徑地改善市民群眾居住質量和環境。
    (十六)繼續推進歷史文化風貌區和優秀歷史建築整治。在嚴格執行上海市歷史文化風貌保護區規劃和《上海市歷史文化風貌區和優秀歷史建築保護條例》有關規定的情況下,繼續推進歷史風貌保護區和優秀歷史建築保護整治試點,在有效保護歷史建築風貌的同時,努力改善居民的居住條件。
    六、進一步完善組織協調機制和工作制度
    (十七)建立舊區改造工作協調機制。成立上海市舊區改造工作領導小組,由市政府主要領導擔任組長,分管副市長擔任副組長,市建設交通委、市住房保障房屋管理局、市規劃國土資源局、市發展改革委、市經濟信息化委、市國資委、市財政局、市公安局、市監察局、市民政局、市金融辦、市政府法制辦、市政府新聞辦、市信訪辦和中心城區10個區為成員單位。領導小組辦公室設在市建設交通委。
    有關各區政府要成立相應機構,負責本區域範圍內舊區改造組織實施工作。有關街道(鎮)要全力配合,協同推進舊區改造,並做好社會穩定和居民思想工作。
      (十八)落實工作責任。有關區政府主要領導是本區舊區改造工作的第一責任人,實行目標責​​任制管理,納入政績考核範圍,並接受人大、政協的監督以及社會各界、市民群眾的監督。
    (十九)引入第三方參與房屋拆遷的監督。在堅持“陽光拆遷、公開操作”制度的基礎上,有關各區可邀請人大代表、政協委員、社區工作者、法律界人士等,參與房屋拆遷全過程監督。
      (二十)營造良好社會氛圍。各級政府要進一步強化舊區改造大局意識、群眾意識、責任意識,注重發揮新聞媒體宣傳引導作用,提高市民群眾的參與意識,增強市民群眾對舊區改造的理解和支持。
      本意見自印發之日起施行。此前發布的本市舊區改造有關規定和政策與本意見不一致的不再執行。

      坚持公开透明、公平公正。进一步突出旧区改造公益性的特征,努力形成居民主动参与、操作规范有序、社会广泛支持的良好局面。
      坚持点面结合、突出重点。在积极推进已启动旧改项目改造的同时,加大力度,重点推进中心城区成片、成规模和群众改造意愿强烈的二级旧里以下房屋改造。
      坚持政府主导、以区为主。市政府负责统筹、协调、推进和政策制定等工作,有关区政府作为旧区改造的责任主体,具体承担组织实施和推进工作。
      二、积极探索旧区改造新机制

      四、多渠道筹措动迁安置房源
      (十二)积极推进就近安置房建设。有关各区根据市建设交通委制定的保障性住宅建设技术标准,在本区域范围内建设适配的紧凑型、小户型就近安置房。就近安置房建设、销售、管理等,参照本市配套商品房有关规定执行。
