动拆迁回归“非营利”, 公共利益防缩水

针对近年来因动迁引发的各种社会矛盾，China国务院,2011年初,颁布了《 国有土地上房屋征收与补偿条例》，上海为此,也制定了相应的实施细则。
近日，即将在Shanghai市政府常务会议审议的《 上海市国有土地上房屋征收与补偿实施细则（草案） 》,在中国上海市政协通报情况征询意见，委员们提出5条完善细化建议，防止-被钻空子,打“擦边球”。
据中国Shanghai市住房保障和房屋管理局负责人通报，《 实施细则 》,在拆迁许可、补偿标准、行为主体、争议处理机制等方面,与以前,有了很大不同。委员们对于《 实施细则 》将动拆迁的主体,从动迁公司的市场化运作,回归到-政府部门主导、不以营利为目的的-正确轨道,非常赞同，认为:这将有利于促进上海动拆迁工作-健康,有序,发展,和动拆迁矛盾的防范和化解。
在此基础上，中国Shanghai市政协委员,提出了不少建议。委员们认为，对于因公共利益,需征收上海房屋的六条情况,要细化界定，防止被钻空子,打“擦边球”，特别是-对因公益性服务需要的建设，建成后,又是民营和市场化运作的项目，要有明确的界定和解释，防止“公共利益”被缩水和扭曲。
